These Terms of Service ("Terms") govern your access to and use of app.versysmedia.com, the applications, game utilities, demonstrations and related content made available through it (collectively, the "Platform"). By using the Platform you agree to these Terms. If you do not agree, do not use the Platform.
1. Eligibility and acceptance
You must have the legal capacity required in your jurisdiction to agree to these Terms. Where you use the Platform for a business or organisation, you confirm that you are authorised to act for that organisation.
2. The Platform and changes
Versys Apps is an evolving product platform. Features, datasets, availability, integrations and individual products may change, be corrected, be suspended or be discontinued. We may deploy updates without prior notice where reasonably necessary for security, reliability or product development.
Some products store information locally in your browser. You are responsible for maintaining any backups you consider necessary for locally stored or exported data.
3. AI Caller and communications
The AI Caller is an on-demand demonstration. You may submit only a phone number that you are authorised to use and for which you are authorised to request the call. You consent to the specific automated call you request and to any follow-up you separately permit.
You may not use the AI Caller for harassment, impersonation, fraud, unsolicited campaigns or to cause calls to people who have not authorised the request. You remain responsible for complying with laws that apply to your use of automated communications, telemarketing, caller identification, consent and call recording in your jurisdiction.
4. Acceptable use
You must not:
- use the Platform unlawfully, fraudulently or to violate another person's rights;
- attempt to bypass authentication, access controls, rate limits or security measures;
- probe, scan or test systems for vulnerabilities without our written authorisation;
- introduce malicious code or interfere with service availability;
- use the Platform to send spam, abusive communications or unauthorised automated calls;
- misrepresent your identity, affiliation or authority; or
- use the Platform in a way that imposes an unreasonable load on infrastructure or materially interferes with other users.
5. Automated access, scraping and datasets
Ordinary search-engine indexing is permitted when performed in accordance with our robots directives and reasonable crawl behaviour. Unless we give written permission, you may not use bots, scripts or automated tools to bulk extract, mirror, republish, commercially exploit, train models on, or build a substitute dataset from substantial portions of the Platform or its proprietary content.
You may not evade technical controls, rotate identities to bypass rate limits, or continue automated collection after access has been blocked or restricted. Public availability of a page does not grant a licence for unrestricted bulk extraction or republication.
6. Intellectual property
Versys Media and its licensors retain their rights in the Platform's original software, design, branding, text, databases, compilations and other original materials. Subject to these Terms, you receive a limited, revocable, non-exclusive right to use the Platform for its intended purpose. No ownership rights are transferred to you.
Third-party game names, artwork, icons, data and other materials remain the property of their respective rights holders. Pal Atlas is an unofficial fan companion and is not affiliated with or endorsed by Pocketpair, Inc.
7. Third-party services and links
The Platform may depend on or link to third-party hosting, communications, automation, mapping, analytics or other services. Those services can have their own terms and privacy practices. We are not responsible for third-party services outside our control.
8. Accuracy, availability and disclaimers
The Platform is provided on an "as is" and "as available" basis to the extent permitted by law. We do not promise that every dataset, game record, calculation, AI output or third-party integration will always be complete, current or error-free. You should verify information before relying on it for important decisions.
Nothing in these Terms excludes warranties, remedies or consumer rights that cannot lawfully be excluded.
9. Limitation of liability
To the maximum extent permitted by applicable law, Versys Media will not be liable for indirect, incidental, special or consequential loss arising from use of or inability to use the Platform, including loss of data, profits, business opportunity or goodwill. Where liability cannot legally be excluded, it is limited only to the extent permitted by law.
10. Responsibility for misuse
To the extent permitted by law, you are responsible for losses or claims resulting from your unlawful use of the Platform, your unauthorised use of another person's contact details, or your material breach of these Terms.
11. Suspension and termination
We may restrict, suspend or terminate access where we reasonably believe it is necessary to protect users or infrastructure, respond to abuse or security threats, comply with law, or address a material breach of these Terms. Where practical, proportionate measures will be used.
12. Privacy
Our Privacy Policy explains how personal information is handled in connection with the Platform and forms part of the terms governing your use of products that process personal information.
13. Governing law
These Terms are governed by the laws of the Republic of South Africa, subject to any mandatory law that applies to you and cannot legally be excluded. Disputes will be handled by a court or forum with lawful jurisdiction. Before formal proceedings, the parties should attempt in good faith to resolve the dispute directly where appropriate.
14. Changes to these Terms
We may update these Terms when products, security requirements or legal obligations change. The revision date at the top of this page shows the latest version. Continued use after an updated version becomes effective constitutes acceptance to the extent permitted by law.
